General conditions of Sale


1. General Provisions.

(a) The terms and conditions indicated below (the "General Conditions of Sale") form an integral part of the contracts
concluded between the company and the customer for the rental of our vehicles and / or the use of our services.

(b) The General Conditions of Sale apply to all transactions concluded between the company and the customer without the
need for an express reference to them or a specific agreement to that effect at the conclusion of each individual
transaction. Any different conditions or terms apply only if confirmed in writing by the company .

(c) The company reserves the right to alter, amend or change the Terms of Sale, attaching these changes to advertising and /
or packages offert to



2. Legislative sources

With the acceptance and signing of the travel contract, the following rules will also be considered valid in addition to the
legal regulations governing the sale of tourist packages and services pursuant to art. 3 of Legislative Decree . n. 79 of 23 May

If a purchase is considered fraudulent, the Tourist Service has the right to cancel the order relating to that purchase .

5. Reservation of the service

The booking of the service takes place after having clearly read what the service offers, the costs and timing of the rental of
the vehicles and / or products offered. Once the service has been added to the cart, there is still time for any changes until the
payment is made. Reservations can be made directly in the company or through the company
website www.touristservice2006.com .

The customer undertakes jointly for himself and for all the persons included in the reservation sent.



6. Disclaimer of Liability

By purchasing a Product you accept and approve the relevant Conditions of Service, including the cancellation policy for
reasons of non-reaching number of participants and any additional conditions that may apply to your booking during the tour



7. Payment

Once the selected products, the relative quantities and the number of people have been added, the ticket is paid in the
appropriate secure platform for this procedure.

Tourist service will send, in the email provided at checkout or to the email provided during registration, the ticket issued for
the chosen product / s.



8. Insurance against cancellation costs

If not expressly included in the price, there are no costs for canceling the ticket issue



9. Booking change, replacement person and / or ticket refund

After the ticket has been issued, it is possible to request some changes such as date change or product change booked; as
regards all requests for changes, an email must be sent to touristservicecatania@gmail.com , acceptance of this change is at
the discretion of the company.



The request email must have the ticket number in the subject and the description of the request must refer explicitly and
clearly:
- ticket number
- chosen product
- date of the chosen product
- number of customers booked
- which variations and / or modifications are requested


There are no ticket reimbursement costs for errors or changes in the purchased products, but only, at the discretion of the
company, for reasons referred to in point 11 of these conditions of sale.



10. Services not used

If the customer does not use single services offered regularly and forming part of the contract due to his fault (eg: for late
arrival at the time of the transfer or for early departure) he has no right to partial refunds. Tourist service undertakes to obtain
partial refunds from service providers, if the non-use is not attributable to the customer.

Trip cancellation due to failure to reach the minimum number of participants

In the case of trips that require a minimum number of participants expressly indicated in the Tourist service offers , the latter
may cancel the trip no later than 24 hours from the date of the tour set.

The Tourist service must give written notice to the customer and refund 100% of the sums paid up to that
moment. The Tourist Service has no obligation to reimburse expenses by the customer (eg .: flights) that were not part of the
product sold.



12. Tour cancellation for behavioral reasons

In the case of group travel, Tourist service reserves the right to withdraw from the contract with the customer who, despite
the warning from the Tourist Service , continues to maintain a disturbing action or a behavior in contradiction with the
contractual clauses.



13. Obligations of the customer

Notification of complaints.

If the travel services are not provided in accordance with the contract, the customer can demand the remedy. However, the
customer is obliged to report any request for remedy within 48 hours at the latest. If this does not happen, he is not entitled
to any remedy. Any complaints at the end of the trip must be reported immediately and no later than 10 days after the return
of the trip. The complaint must be addressed to the Tourist Service , at the address and telephone numbers indicated on the
site on the contact page . If a complaint is justified on the spot to a representative of the Tourist service and the opportunity
to ask immediately remedy, it will care Tourist service providing, so that the customer can use the services guaranteed in the
contract. If the customer wants to withdraw from the travel contract and the complaint is justified, he must in any case
give Tourist service the possibility to remedy it within an agreed period of time.

The customer is still required to limit the damage or to notify Tourist service in case of danger of damage.



14. Limitation of Liability and Indemnification

The compensation limit for damages that do not concern the person is set at 3 times the price of the package / service booked
if:

- 1. The damage caused to the customer did not occur either through negligence or gross negligence

- 2. Tourist service is orig to responsible for damage caused in the service.

Tourist service is not responsible for damages caused by services and performances not included in the travel contract and
attributable to third parties. For all transport, the regulations of each service provider apply.

Tourist service is not responsible in any way, if the customer has a damage due to his own negligence or non-observance of
the rules prescribed by Tourist service.



15. Exclusion from the right to compensation and expiry of the statute of limitations

The customer may claim compensation for services included in the contract and not provided or not adequately provided. The
customer must also - under penalty of forfeiture - lodge a complaint by sending a registered letter, with acknowledgment of
receipt, or other means that guarantees proof of receipt, to the Tourist service no later than ten working days from the date
of receipt. return to the place of departure.

Compensation claims for bodily or health damage caused by negligent or willful breach of duty by Tourist service or its legal
representative, lapse within one year from the date on which the booked service contractually ends. The request must be sent
exclusively to the address of the Tourist service headquarters .



16. Jurisdiction and competent court

The contractual relationship between the customer and Tourist service is governed exclusively by Italian law. Jurisdiction
is Catania - Italy.



17. Privacy protection

Information on the processing of personal data (Article 13 of EU regulation 2016/679)

The data of the subscriber of the contract and those of the other participants, whose conferment is mandatory to guarantee
them the use of the services covered by the tourist package purchased, will be processed manually and / or electronically in
compliance with the law. Any refusal to provide the data will make it impossible to conclude the contract and provide the
related services. The data controller is - unless otherwise specified and otherwise indicated, possibly also visible in the catalog
and / or on the respective websites - the Tourist service in the person of Giuseppe Caruso. Where necessary, the data will be
communicated only to competent authorities, insurance companies, correspondents or local representatives of
